miscarriage of justice?

yeah they both look like yobs to me...thinking

Identical twins both go on trial for assault because victim can't identify which one hit him

When it comes to bringing an alleged criminal to justice, proving identity can be a difficult task for the prosecution. Especially if he has an identical twin brother. So when Darryl Churchill complained he had been attacked by either Gavin or Rhys Higgins, the Crown Prosecution Service doubled their efforts - and put both men in the dock.

Yesterday the two 21-year-olds appeared in court charged with assaulting Mr Churchill at a rugby club party. Mr Churchill told how one of the twins set upon him after a dispute over a game of pool which he had refereed. The court heard he was 'punched and kicked' and needed an operation to fix his nose after the alleged attack, but could not tell which brother was responsible because they look so alike.

The 40-year-old said: 'It was one of the twins - I don't know which one.' Asked which twin had dealt the first blow, he told the jury at Cardiff Crown Court: 'I don't know, they both look the same to me.'

The twins, of Blaengarw, both deny one charge of assault causing actual bodily harm.
